Your privacy is important to Art Intelligence (referred to herein as “AI,” “we,” or “us”). This Privacy Policy describes how we might collect, use, share, and protect information you provide to us through this website (the “Site”) or by e-mail. By using the Site, you hereby consent to allow us to process information in accordance with this Policy. Please also refer to our Terms of Use, which are incorporated as if fully recited herein, if you have not already done so.

USE OF INFORMATION
Art Intelligence does not systematically collect personally identifiable information other than your name and e-mail, which we collect when you voluntarily register for the Site or contact us.  Any information you voluntarily input into the Site will be retained in our database. We may use this information to communicate with you via electronic newsletters or e-mail about our products, services, promotions and other items. If you no longer wish to receive such materials, you may opt-out by following the unsubscribe instructions included in our communications to you.

We may also gather automatically collected information – i.e. non-personally identifiable information such as age, gender, products purchased, device used and its operating system, pages accessed, applications downloaded, and/or search terms entered – by using Tracking Internet Protocol (IP) addresses (an IP address is a number automatically assigned to your device whenever you surf the Internet), web beacons, pixel tags, embedded links, and other commonly used information-gathering tools. We may use automatically collected information to help us develop and improve our Site, business, and other products.

Our Site uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to collect non-personally identifiable information. We may also communicate with you (and you may communicate with us) through social media sites.  We may collect information posted on social media sites about you, and about your friends and followers, to the extent permitted by the social media sites themselves.  We may use comments that you post on social media about us, our Site, or our other products or services and you consent to our using or copying such postings in other forums without payment. We will not use the full name of any poster, but may use poster’s first name and last initial.

INFORMATION SHARING
Art Intelligence does not share any of your personally identifiable information with any other party, except as specified in this Privacy Policy.  We may share your personally identifiable information with our consultants, service providers, advisors and affiliates on a confidential basis without any further right of disclosure. We may share automatically collected information with third parties to perform analysis and for consulting. We may also disclose information to enforce and comply with the law, defend a legal claim, protect a person in our discretion and/or otherwise prevent activities that are illegal, unethical, or legally actionable. Further, we may transfer your information to a successor in interest, such as in the event of an acquisition, sale, merger or bankruptcy.

SECURITY AND SSL
The security of your information is important to us. Our Site may employ procedural and technical safeguards such as MySQL to secure your personally identifiable information against loss, theft, and alteration as well as unauthorized access, use and disclosure. However, we cannot ensure or warrant the security of any information you transmit to us, and you transmit such information at your own risk.

Our Site may contain links to other websites.  We are not responsible for the privacy practices of other websites.  When you leave our Site to visit another website or application, please read the privacy statements of these websites, as this Privacy Policy applies solely to information collected by this Site.

CHILDREN AND PRIVACY
We are concerned with the safety of children on the Internet. Art Intelligence does not knowingly collect personally identifiable information from children under the age of 13. If we become aware a child under the age of 13 has registered with this Site without verifiable parental consent, we will remove his or her personal information from our files.  If you are the parent or guardian of a child under the age of 13 who has provided personal information to us without your approval, please contact us at the e-mail address below and we will remove such information from our database.

TERRITORIALITY
Your information will be processed in the United States. BY VISITING THIS WEBSITE, YOU UNEQUIVOCALLY AND UNAMBIGUOUSLY CONSENT TO THE COLLECTION AND PROCESSING IN THE UNITED STATES OF ANY INFORMATION COLLECTED OR OBTAINED BY US THROUGH VOLUNTARY SUBMISSIONS, AND THAT U.S. LAW GOVERNS ANY SUCH COLLECTION AND PROCESSING.

GOVERNING LAW
This Agreement shall be interpreted and governed by the law of the State of New York without regard to its conflict of laws principles. You expressly acknowledge and agree that any claim brought in connection with this Agreement or the subject matter herein shall only be brought in a federal or state court located in the State of New York, in the County of New York, and you expressly waive all objections you might have to jurisdiction, venue, service of process, forum non conveniens or the like in connection therewith.

ADDITIONAL
UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM YOUR DECISION TO PROVIDE INFORMATION VIA OUR SITE.  IF THE FOREGOING LIMITATIONS ARE HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THEN THE MAXIMUM LIABILITY OF US TO YOU FOR ANY TYPE OF DAMAGES SHALL BE LIMITED TO THE GREATER OF PAYMENTS YOU HAVE MADE TO US IN THE SIX (6) MONTHS PRIOR TO THE ACTION OR CLAIM YOU HAVE ASSERTED AS GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100.00).

If any provision of this Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.  Our failure to enforce any term or condition of this Policy shall not be deemed a waiver thereof and shall not prevent its later enforcement.
